Estate administration is an important part of succession law. It requires a set of procedures and involves the presence of administrative bodies in Malaysia namely the Civil High Court, Estate Distribution Unit, Amanah Raya Berhad (ARB), and Syariah Court. Each administrative body’s responsibilities are distinct from one another and are indicated by the scope of its authority through its jurisdiction. Disputes during the estate administration process sometimes occur, particularly one involving family members. When this happens, the estate administration is prone to delay, thus the process could not be completed. Therefore, to overcome this matter, this book suggests that administrative bodies to implement mediation in their practice since mediation is effective, particularly in remedying the emotional distress of the disputing parties in estate administration cases. Since mediation has many benefits, the author believes that mediation is the most suitable type of Alternative Dispute Resolution (ADR) in resolving disputes in estate administration cases. Therefore, to implement mediation in the administrative bodies, the stakeholders and the involved parties must play a role by upholding mediation to be part of the practice by the administrative bodies which can benefit not only the public but also improve the overall process in estate administration.
